1. Acceptance of Terms

By downloading, accessing, or using the BORD mobile application (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree, you may not use the App.

2. About BORD

BORD is a digital learning and assessment platform designed to help individuals enhance their skills through structured content, quizzes, AI-generated learning modules, and progress tracking tools. The App is intended for users located in the Kingdom of Saudi Arabia.

3. Eligibility

You must be at least 13 years old to use BORD. If you are under 18, you must have the approval and supervision of a parent or legal guardian.

4. User Accounts

To use certain features, you must create an account with a valid email, ID number, and/or phone number. You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.

5. User Responsibilities

By using the App, you agree not to:

  • Violate any applicable Saudi laws or Islamic values.
  • Post or share any content that is defamatory, obscene, offensive, or contrary to public morals.
  • Use the App for commercial exploitation or unauthorized advertising.
  • Harm, disrupt, or interfere with other users or the integrity of the platform.

6. Compliance with Saudi Laws

The App operates under the jurisdiction of the Kingdom of Saudi Arabia. You agree to comply with all applicable local laws, including but not limited to:

  • Anti-Cyber Crime Law
  • E-Commerce Law
  • Personal Data Protection Law (PDPL)

All unlawful acts (e.g. hate speech, impersonation, spreading false information) will result in account suspension and may be reported to relevant authorities.

7. Intellectual Property

All content in the App—including text, images, course materials, videos, audio clips, designs, AI-generated content, and software—is the property of Al-Mubtadaa Information Technology Company or its licensors and is protected under Saudi copyright and international laws. You may not reproduce, redistribute, or modify any content without permission.

8. Subscriptions and In-App Purchases

BORD may offer premium features via in-app purchases or subscriptions:

  • Payments are processed via Apple or Google and governed by their respective terms.
  • Subscriptions will automatically renew unless canceled at least 24 hours before the end of the billing period.
  • You may manage or cancel subscriptions via your device's App Store or Google Play account settings.

All purchases are final unless otherwise required by Saudi consumer protection regulations.

9. Data Protection and Privacy

Your personal data will be handled in accordance with Saudi Arabia's Personal Data Protection Law (PDPL) and our Privacy Policy. We are committed to protecting your privacy and storing your data securely.

BORD may use aggregated, anonymized user data to improve learning outcomes and optimize content using artificial intelligence (AI). AI-generated content and suggestions do not constitute professional advice.

All personal and sensitive data collected is stored within Saudi Arabia and encrypted during storage and transmission.

10. Role-Based Access and Permissions

The App includes role-based access control to ensure data integrity. Users are granted permissions based on their role (e.g., Worker, Admin). Misuse of access privileges or attempts to bypass role-based restrictions may lead to suspension or legal action.

11. Offline Use and Licensing

Some learning modules may be downloaded for offline access. Offline use does not transfer ownership of any intellectual property or content licensing. Users may not distribute or extract downloaded content for external use.

12. Service Availability

We do not guarantee uninterrupted access to the App. Features may be modified, paused, or discontinued at any time for operational, security, or legal reasons.

13. Third-Party Services

The App may include links or integrations with third-party services. We do not control these services and are not responsible for their content or practices. Your use of such services is at your own risk.

14. Termination

We reserve the right to suspend or terminate your access to the App without notice if:

  • You violate these Terms or any applicable laws.
  • You engage in behavior deemed harmful to other users or the platform.

15. Limitation of Liability

To the maximum extent permitted under Saudi law, Al-Mubtadaa Information Technology Company shall not be liable for any indirect, incidental, or consequential damages resulting from your use or inability to use the App.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Riyadh.

17. Amendments to Terms

We may update these Terms at our discretion. If changes are material, we will notify users through the App or by email. Continued use after updates means you accept the revised Terms.
